These Terms of Service (“Terms”) apply to your access to and use of (a) the website located at https://icebox.cloud/ and all associated web pages (the “Website”) provided by Icebox (“Icebox,” “we,” “our,” or “us”) and (b) any online services including our AI Image Generator ((a) and (b), collectively, our “Services”).

Users under 18 years of age may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. The parent or legal guardian is fully responsible for the acts or omissions of such user in relation to our Services.

In using our Services, you represent and warrant that you meet the eligibility requirements and have the authority to be bound by these Terms.

Accounts

Currently, Icebox does not require account registration to use our free AI Image Generator. However, we may introduce account features in the future. If accounts become available, you will be required to maintain the security of your account and promptly notify us if you discover unauthorized access.

2. Your Information and Communications

You may provide certain information to us in connection with your use of our Services. For information about how we collect, use, share and process information about you, please see our Privacy Policy.

You agree to receive all communications, agreements, and notices that we provide in connection with our Services electronically, including by email or by posting them on the Website.

3. User Content and Generated Images

Input and Output

You may provide text prompts as input to the Services (“Input”), and receive AI-generated images from the Services based on the Input (“Output”). Input and Output are collectively referred to as “User Content.”

        Ownership: You own all right, title, and interest in and to the User Content that you generate by using our Services. This means you may use your generated images for any purpose, including commercial purposes, provided that your usage complies with these Terms.
    

Your Responsibilities

You represent and warrant that:

You have all rights, licenses, and permissions needed to provide Input to our Services
Your Input will comply with applicable law and these Terms
Your User Content will not violate any rights of any person or entity
You will not rely on AI-generated Output as a sole source of truth or factual information

Our Use of User Content

We may use User Content to provide, maintain, develop, and improve our Services, comply with applicable law, enforce our terms and policies, and keep our Services safe.

4. Prohibited Content and Conduct

⚠️ STRICTLY PROHIBITED: You may NOT create, upload, share, or generate any content that violates the restrictions below. Violations may result in immediate termination of access to our Services.

You may NOT create or generate content that:

Is unlawful, libelous, defamatory, obscene, pornographic, sexually explicit, indecent, lewd, harassing, threatening, or abusive
Would constitute, encourage, or provide instructions for a criminal offense
May infringe any patent, trademark, trade secret, copyright, or other intellectual property right
Impersonates or misrepresents your affiliation with any person or entity
Contains any private or personal information of a third party without consent
Depicts an individual in a false, misleading, or deceptive manner
Depicts any minor under the age of 18 in any inappropriate manner
Contains viruses, corrupted data, or other harmful or destructive files
In our sole judgment, is objectionable or may expose Icebox or others to harm or liability

General Prohibited Conduct

You will NOT:

Violate any applicable law, contract, or third-party right
Use or attempt to use another user’s account without authorization
Sell, resell, or commercially exploit our Services without authorization
Copy, reproduce, distribute, or create derivative works from our Services
Reverse engineer, decompile, or attempt to discover source code of our Services
Use data mining, robots, or similar automated tools to scrape or extract data
Interfere with, disrupt, or negatively affect the functioning of our Services
Use our Services for any illegal or unauthorized purpose

Enforcement

We may remove or disable access to content, suspend or terminate accounts, and cooperate with law enforcement if we determine content or conduct violates these Terms or applicable law.

Our Services

Icebox or our licensors own all right, title, and interest in and to our Services, including all text, graphics, images, software, and other content. Except as expressly stated in these Terms, all rights are reserved.

Subject to your compliance with these Terms, you are granted a limited, nonexclusive, nontransferable, revocable license to access and use our Services for your personal use.

Generated Content License

        🎨 Free to Use: All images generated by Icebox AI Image Generator are free of copyright restrictions. You may use them for any legal purpose including commercial use, without watermarks or attribution requirements.
    

Trademarks

The “Icebox” name, our logos, and the look and feel of our Services are trademarks of Icebox and may not be used without our prior written permission.

6. Third-Party Materials and Links

Our Services may rely on or link to third-party products, services, and websites. These Third-Party Materials are beyond our control. We are not responsible for:

Icebox will exclusively own all improvements to our Services based on any Feedback. We may treat Feedback as nonconfidential.

AS-IS SERVICE: OUR SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF OUR SERVICES.

AI Output Disclaimer: You accept and agree that any use of AI-generated images is at your sole risk. You should not rely on AI Output as a sole source of truth, factual information, or as a substitute for professional advice. Always verify the accuracy and appropriateness of generated content.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

No Indirect Damages

Icebox will NOT be liable for any indirect, consequential, exemplary, incidental, punitive, or special damages or lost profits, even if we have been advised of the possibility of such damages.

Liability Cap

The total liability of Icebox to you, regardless of the form of action, is limited to $100 USD or the amount you paid to use our Services (currently $0 for free services), whichever is greater.

User Disputes

You release Icebox from any claims related to disputes between users or acts of third parties. We are not responsible for user conduct or third-party actions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Icebox and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to:

Your use of our Services
Your User Content or Input
Your violation of these Terms
Your violation of any rights of another person or entity

11. Governing Law and Disputes

Governing Law

These Terms will be governed by and construed in accordance with the laws of Indonesia, without regard to conflict of law principles.

Dispute Resolution

If informal resolution fails, disputes will be resolved in the courts of Jakarta, Indonesia. You and Icebox irrevocably consent to the exclusive jurisdiction of such courts.

Time to File Claims

Any claim relating to these Terms or our Services must be filed within one (1) year after the claim arises; otherwise, the claim is permanently barred.

Modifications to Services

We reserve the right to:

Modify, suspend, or discontinue all or part of our Services at any time
Change, modify, or waive any fees for our Services
Offer different features to different users

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or government actions.

Defame, disparage, or harass others
Discriminate against individuals or groups based on protected characteristics
Provide medical, legal, or financial advice
Circumvent content filters or safety mechanisms
Attempt to generate content that violates ethical AI guidelines
